These regulations apply to all users of Atom, including but not limited to bot administrators, server owners, and community members. When using Atom, whether you are managing a server, interacting with the bot, or participating in any way, you are bound by these terms, which outline the expectations, responsibilities, and rights of both users and the Atom team. It is essential that you thoroughly review and fully understand these terms before proceeding with the use of Atom.

Atom is designed to foster a safe, reliable, and productive environment for all members of the Discord communities that use it. By agreeing to these Terms, you acknowledge the importance of maintaining these values and commit to ensuring that Atom is used in a manner consistent with these principles. The Terms cover a wide range of aspects, from subscription policies and user conduct to data management and community moderation, which are all critical for the smooth operation of Atom within your server and interactions with other users.

Adhering to these Terms is vital to not only protect the integrity and performance of Atom but also to ensure that all users are treated fairly and respectfully. Failure to comply with any part of these Terms may result in account suspension, loss of access to premium features, or, in extreme cases, the termination of service. Therefore, it is highly recommended that you read and regularly review these Terms, as they may be updated periodically to reflect changes in our services or legal obligations.

Additionally, by accepting these Terms, you agree to take full responsibility for the actions and behaviors of your server members while interacting with Atom. You are also agreeing to uphold the standards and policies set by Atom, which aim to protect the safety, privacy, and overall well-being of the entire Discord community. Ensuring that everyone within your community adheres to these standards is not just encouraged, but required to maintain the quality and integrity of the Atom experience for all users.

Use of Services

Atom offers a comprehensive suite of leveling features tailored specifically for Discord servers. These features include, but are not limited to, experience points, levels, leaderboards, and customizable user roles. Atom provides these tools to enhance the engagement and interaction of server communities by promoting positive behaviors and rewarding members for their participation. Atom is designed to offer a rich and seamless experience for server owners and administrators, giving them the ability to create a dynamic and rewarding environment for their community members.

Permitted Use:
You are granted the right to use Atom exclusively for non-commercial purposes, in accordance with these Terms. Non-commercial use means that Atom should be used for personal, recreational, or community engagement purposes, and not for any profit-making activity or business venture. For instance, leveraging Atom to sell access to premium features or resell the service in any form is strictly prohibited. The use of Atom in any way that aims to generate revenue or for any business-related purposes, without prior written consent from the Atom team, constitutes a violation of these Terms.

Prohibited Activities:
Any use of Atom that involves illegal, harmful, or unauthorized activities is strictly prohibited. This includes, but is not limited to:

  • Exploiting or abusing the features of Atom for malicious purposes, such as gaming the leveling system, exploiting bots, or manipulating leaderboards in ways that violate fair play.
  • Engaging in harassment, bullying, or any form of disruptive behavior toward other users or members of the community through Atom’s features.
  • Using Atom to distribute or promote harmful content, including malware, viruses, or any material that could damage or compromise the functionality of Discord servers or other systems.
  • Violation of intellectual property rights, such as using Atom to infringe upon copyrights, trademarks, or other protected works.

User Accountability:
As a user of Atom, you are solely responsible for how you utilize the service and must ensure that your actions comply with these Terms at all times. This includes ensuring that your actions within your server, and the actions of your members, do not violate Atom’s Terms or any applicable laws. You are also responsible for monitoring your server’s use of Atom and ensuring that all participants within your server adhere to these regulations. Atom reserves the right to suspend or terminate your access to the service if it is found that you are in violation of these Terms, without prior notice.

Monitoring and Enforcement:
Atom retains the right to monitor all usage of the service to ensure compliance with these Terms. We also reserve the right to take action against users who engage in activities that violate the policies outlined herein. Such actions may include, but are not limited to, temporary suspensions, permanent bans, or loss of premium features. In the event of a breach of these Terms, Atom will take appropriate measures to protect the integrity of the service and the safety of its users.

By agreeing to use Atom, you acknowledge that you understand the importance of responsible usage and agree to refrain from any actions that could compromise the quality of service for yourself, other users, or the broader Discord community. We encourage users to report any misuse or violations of these Terms to ensure that Atom remains a positive and productive tool for all users.

User Conduct

Users are entrusted with the responsible and respectful utilization of Atom, and as such, are expected to uphold a high standard of conduct while using the service. This responsibility includes refraining from any actions that could disrupt the functionality of Atom, compromise its integrity, or harm the experience of other users. It is imperative that users take great care to ensure that their behavior aligns with the principles of fairness, respect, and safety, both for themselves and the broader community.

Prohibited Conduct:
Users must refrain from any behavior or actions that could negatively impact Atom or its users. This includes, but is not limited to:

  • Unauthorized Access: Attempting to gain unauthorized access to Atom’s system, code, or servers, whether through hacking, exploitation of vulnerabilities, or any other means, is strictly prohibited.
  • Spamming: Using Atom or any of its features to spam messages, commands, or content within Discord servers is not permitted. This includes excessive or repetitive messaging, bot commands, or any form of disruption that could degrade the experience for others.
  • Harassment and Abuse: Any form of harassment, bullying, threatening, or abusive behavior toward other users, server members, or Atom’s staff will not be tolerated. This extends to any actions or communications that create an unsafe or hostile environment within the server.
  • Unlawful Activities: Engaging in or promoting unlawful activities while using Atom, such as distributing illegal content, using the service to facilitate illegal actions, or violating intellectual property laws, is strictly prohibited.

Ethical and Legal Compliance:
All users must adhere strictly to all applicable laws, regulations, and ethical standards governing the use of Atom and the Discord platform. Users are responsible for ensuring that their actions while using Atom comply with local, national, and international laws, including but not limited to privacy, data protection, and intellectual property laws. Any activities that violate these laws are a breach of Atom’s Terms of Service and will result in immediate action to restrict or terminate access to Atom.

Respecting Other Users:
Users are expected to treat others with respect and courtesy when interacting with Atom’s features. This includes maintaining professionalism and positive behavior in communication with other members and ensuring that interactions through Atom enhance rather than disrupt the experience of others. The use of Atom to promote divisiveness, hate speech, or discrimination based on race, gender, religion, nationality, or any other form of identity is strictly forbidden.

Monitoring and Accountability:
Atom reserves the right to monitor the usage of the service to detect and address any conduct that violates these Terms. We take these violations seriously and have measures in place to identify and penalize users who engage in disruptive or harmful behavior. These measures may include temporary or permanent suspension of access to Atom, removal of premium features, or complete termination of the user’s account. In addition, users who cause significant harm to the community or the operation of Atom may be reported to the relevant authorities, as appropriate.

Disciplinary Action:
Failure to comply with these guidelines and Terms of Service may result in disciplinary action, depending on the severity of the violation. Such actions may range from warnings and temporary suspensions to permanent bans or legal action in extreme cases. Atom will assess violations on a case-by-case basis and take the necessary steps to protect the service and its users. If disciplinary action is taken, users will be notified of the reason for the action and the steps they can take to rectify the situation, if applicable.

By accessing and using Atom, users implicitly agree to uphold these principles and accept full accountability for their actions. This includes ensuring that they do not engage in any activities that could harm the experience of others, damage the integrity of Atom, or violate legal or ethical standards. Atom relies on its users to foster a community that prioritizes respect, fairness, and positive engagement, and we count on each user to be a responsible and contributing member of that community.

User Control and Access

Users have the right to access, modify, or request deletion of their personal data at any time, in accordance with our Privacy Policy. Users have the right to request the deletion of their personal data at any time. To initiate the deletion process, users can contact Atom’s support team. Once a deletion request is received, Atom will process it in accordance with its privacy policies, and users will be notified of the outcome. Users who have questions or concerns about how their data is being handled can reach out to the Atom support team. Data Export Requests
While users have the ability to access and modify their personal data, requesting to export this data will not typically be fulfilled on demand. This is to protect the privacy of users and to prevent any potential misuse of sensitive data. Exporting user data involves complex processes to ensure that it is done securely and in compliance with privacy regulations. As a result, any requests for data export will need to be coordinated directly with the Atom team. Users should not expect an automatic, on-demand ability to export their data, as it may involve specific conditions and approval from Atom.

Conditions for Data Export

Atom employs robust security protocols to safeguard all user data against unauthorized access, loss, or alteration. While users can modify or delete their data at any time, Atom takes significant measures to ensure that all personal information is stored securely and handled in compliance with data protection regulations, such as the General Data Protection Regulation (GDPR) and other applicable laws. Atom is committed to maintaining the confidentiality and privacy of user information at all times, ensuring that it is never exposed to unauthorized parties.

The developers of Atom explicitly disclaim all warranties and representations concerning the service, including but not limited to warranties of availability, accuracy, reliability, fitness for a particular purpose, and non-infringement. This broad disclaimer applies to all aspects of Atom’s functionality, including its performance, features, and compatibility with other software, platforms, or systems.

No Guarantee of Availability or Reliability:
Atom makes no representations or warranties regarding the uninterrupted availability of the service. While Atom is designed to operate continuously, there may be instances of downtime due to maintenance, unforeseen technical issues, or other external factors beyond our control. Users understand and accept that Atom may experience temporary outages, disruptions, or failures in service, and that these occurrences do not constitute a breach of any agreement.

No Guarantee of Accuracy or Suitability:

Atom is a dynamic service that may undergo updates or changes, and while we strive to provide high-quality features, we do not guarantee that all features will meet your specific requirements or expectations. The developers do not warrant that Atom will operate without defects or errors, or that any defects will be corrected. Additionally, Atom may not always perform optimally when integrated with all third-party applications or systems, and compatibility issues may arise.

Inherent Risks:
Users of Atom should be aware that the use of the service carries inherent risks, including the potential for data loss, system instability, or other unintended consequences. Atom is a tool that interacts with complex systems such as Discord, and while we aim to provide a secure and functional service, it is possible for errors or issues to arise during its operation. Users agree to take full responsibility for any consequences that may result from using Atom, including any damage to data, loss of information, or disruptions to server operations. Atom’s developers cannot be held liable for any indirect, incidental, or consequential damages arising from the use of the service.

No Warranty for Third-Party Services or Integrations:
Atom may integrate with third-party services or APIs, but we do not provide any warranties or guarantees regarding the availability, accuracy, or performance of these external services. Users acknowledge that any third-party services used in conjunction with Atom may be subject to their own terms of service, privacy policies, and limitations, and Atom is not responsible for any issues that may arise from these integrations.

Limitation of Liability:
To the fullest extent permitted by applicable law, Atom’s developers shall not be held liable for any direct, indirect, incidental, special, punitive, or consequential damages, or for any loss of profits, data, or business opportunities, arising from the use or inability to use Atom, even if Atom’s developers have been advised of the possibility of such damages. Users assume full responsibility for their interactions with Atom and accept that they are using the service at their own risk.

By accessing and using Atom, users acknowledge that they have read, understood, and accept the terms outlined in this Disclaimer of Warranties. Users agree that Atom is provided without any warranties of any kind, either express or implied, and that they are responsible for any actions taken in connection with their use of the service. Atom developers shall not be liable for any issues, errors, or damages resulting from the use or misuse of Atom, and users accept full responsibility for any consequences that may arise.

Limitation of Liability

In no event shall Atom developers, their affiliates, partners, contributors, agents, or licensors be held liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenues, business opportunities, loss of data, interruption of business, or personal or financial losses arising directly or indirectly from the use or inability to use Atom, its services, any content, features, or software accessed through Atom, or any third-party services integrated with Atom. This includes damages, but limited to, resulting from:

  • Errors or bugs in the functionality of Atom.
  • Delays in or inability to access the Atom service.
  • Service interruptions or downtimes.
  • The accuracy or completeness of any data or information processed by Atom.
  • Failure of third-party services or software that interact with Atom.
  • Any unauthorized access to user data, regardless of whether such access is caused by Atom’s actions or by third-party breaches.
  • Loss or corruption of user data, whether or not the data is backed up.

Exclusion of Liability for Damages:
Atom developers explicitly disclaim all liability for damages, including those arising from the use of Atom in a manner not authorized by these Terms. Users acknowledge that Atom is a complex service that operates in a dynamic environment, and as such, its performance is subject to limitations that may not be within our control. Users accept that Atom developers are not responsible for any direct, indirect, incidental, special, or consequential damages, even if Atom developers have been advised of the possibility of such damages. This includes, without limitation, loss of profits, revenue, business opportunities, data corruption or loss, and service downtime.

No Warranty of Fitness for a Particular Purpose:
Atom is provided on an “as is” and “as available” basis, and no warranties are made regarding its suitability, accuracy, or performance. Atom developers do not warrant that the service will meet the specific needs or expectations of users. Atom is designed to function as a leveling bot for Discord, but developers do not guarantee that it will be free from defects, errors, or interruptions. The developers make no representations regarding the suitability of Atom for any particular purpose, and users assume all risks associated with using the service for any unintended or unauthorized purposes.

Indemnification:
By using Atom, users agree to indemnify, defend, and hold harmless Atom developers, their affiliates, partners, contributors, agents, and licensors from any and all claims, damages, losses, liabilities, costs, and expenses (including but not limited to legal fees and expenses) arising from or related to:

  • Users’ use or misuse of Atom.
  • Violations of these Terms of Service or any applicable law.
  • Violations of third-party rights, including intellectual property or privacy rights.
  • Any breach of user conduct, whether intentional or unintentional, that causes harm to the Atom service or other users.
  • Any claims arising from third-party services or integrations used in conjunction with Atom.

This indemnification obligation will survive the termination or expiration of these Terms of Service.

Exclusion of Liability for Third-Party Content:
Atom may contain or link to third-party content, applications, services, or websites that are not controlled by Atom developers. Atom developers make no representations or warranties regarding the content, accuracy, reliability, or legality of any third-party services, and shall not be liable for any damages arising from users’ access to or use of such third-party content. By using Atom, users acknowledge and accept that any third-party content, applications, or services are not part of Atom’s core functionality, and Atom developers are not responsible for any issues arising from their use.

Force Majeure:
Atom developers shall not be held liable for any failure or delay in performance under these Terms due to causes beyond their reasonable control, including but not limited to natural disasters, acts of government, strikes, failure of the internet or telecommunications networks, or any other event that could disrupt the normal operation of the service. In such cases, the developers will use reasonable efforts to restore normal service as quickly as possible, but cannot guarantee a specific timeline or resolution.

Risk Acknowledgment:
Users acknowledge that Atom is an evolving service that interacts with external systems and services, which may be subject to change or disruption. Atom developers cannot guarantee that the service will always be available or error-free, and users agree to accept all risks associated with using Atom. This includes the risk of potential data loss, service interruptions, or software bugs.

Acceptance of Limitations:
By accessing or using Atom, users agree to the limitations of liability as outlined in this section. Users understand that Atom developers cannot be held responsible for any form of loss, damage, or inconvenience arising from the use or inability to use Atom, and that the use of the service is entirely at their own risk. These limitations apply regardless of the nature of the damages and are enforceable to the fullest extent allowed by law. Users further agree to indemnify and hold harmless Atom developers from any and all claims arising from their use of the service.

Intellectual Property Rights

Atom and its contents, including all software, code, designs, trademarks, logos, graphics, text, and other materials (collectively, the “Content”), are owned by Atom and are protected by intellectual property laws, including copyright, trademark, and patent laws. The Content is the exclusive property of Atom, its affiliates, or its licensors. By accessing and using Atom, users agree to respect and acknowledge these intellectual property rights in their entirety.

Ownership of Content
Atom retains full ownership rights to all Content provided on the platform, including any updates, enhancements, improvements, or modifications that may be made over time. Any feedback, bug reports, or suggestions provided by users, while valuable, remain the property of Atom, unless otherwise specified. By using Atom, users acknowledge that they do not own or acquire any rights to any Content or software associated with Atom, except for the limited, non-exclusive, non-transferable right to access and use Atom’s services in accordance with these Terms.

Limited License
Atom grants users a limited, revocable, non-exclusive, non-transferable license to access and use Atom’s Content solely for personal, non-commercial purposes, and subject to compliance with these Terms. This license does not permit the user to:

  • Copy, reproduce, or redistribute any Content in any form or by any means without the prior written consent of Atom.
  • Create derivative works based on any Content provided by Atom, including any modification, translation, or adaptation.

User-Generated Content
If you submit any content (e.g., feedback, suggestions, posts, reviews, images, or other materials) to Atom, you grant Atom a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, modify, adapt, display, distribute, and otherwise exploit that content as part of Atom’s operations, marketing, or any other activities. This grant extends to all forms of media and communication channels, including but not limited to websites, social media, promotional materials, and advertisements.

  • You also acknowledge that Atom is not obligated to use, respond to, or provide compensation for any submitted content, even if that content is used by Atom.
  • Users submitting content must ensure that they have the necessary rights and permissions to do so. By submitting content, users represent that the content does not infringe on the intellectual property rights of any third parties, and users accept responsibility for any claims that may arise in connection with such content.

Prohibited Use of Trademarks and Content
Users are strictly prohibited from using Atom’s trademarks, logos, or any other protected content without prior written permission from Atom. Unauthorized use of Atom’s intellectual property may result in legal action, including claims for damages or injunctive relief. The prohibition applies to all forms of media, including digital, print, and merchandise.

Protection of Intellectual Property Rights
Atom actively protects its intellectual property and the intellectual property of its partners and licensors. If users become aware of any infringement of Atom’s intellectual property rights or have any reason to believe that their own intellectual property rights have been infringed upon within the platform, they should report the issue to Atom immediately. Atom reserves the right to take appropriate action to enforce its intellectual property rights, including the removal of infringing content and the suspension or termination of offending user accounts.

Third-Party Content
While Atom owns the platform and its content, it may display third-party content, including but not limited to user-generated content, advertisements, and links to external websites. These third-party materials are the responsibility of the third party and are governed by their respective intellectual property rights and terms of service. Atom does not claim ownership of third-party content and does not assume responsibility for its accuracy or legality.

No Transfer of Ownership
Nothing in these Terms grants users any rights, title, or interest in or to the Content, except as expressly provided herein. All intellectual property rights remain the sole property of Atom, its affiliates, or licensors, and users have no right to claim ownership, distribute, or commercialize the Content in any manner not explicitly allowed by these Terms. Users acknowledge and agree that they have no claim to any intellectual property arising from their use of Atom or the content provided therein.

Intellectual Property Infringement
In the event that a user believes their content has been unlawfully used or infringed upon by Atom or another user, they must submit a detailed notice of infringement to Atom’s designated intellectual property agent. The notice should include:

  • A description of the work or intellectual property that has been infringed.
  • A description of where the infringing material can be found on the platform.
  • Contact information for the person submitting the complaint.
  • A statement of good faith belief that the use of the material is not authorized by the owner of the intellectual property or the law.

Atom shall not be held liable or responsible for any delays, failures, or interruptions in service due to events or circumstances beyond its reasonable control, including but not limited to natural disasters, acts of war, terrorism, civil disturbances, government actions, network or server failures, power outages, equipment malfunctions, pandemics, strikes, labor disputes, or any other unforeseen event or condition that impedes or prevents Atom from fulfilling its obligations under these Terms.

Definition of Force Majeure
A force majeure event refers to any event, condition, or circumstance that is beyond Atom’s control, and that prevents or hinders Atom from providing its services as intended. These events may include, but are not limited to, natural disasters (such as earthquakes, floods, or hurricanes), acts of terrorism, wars, pandemics, strikes or labor disputes, fire, mechanical failures, system outages, disruptions in telecommunications or internet services, government regulations, or any other unforeseeable circumstance that prevents Atom from operating normally. Atom will not be held responsible for delays or failure to perform due to such events.

No Liability for Force Majeure Events
Atom is not liable for any loss, damage, or inconvenience caused by delays or failures in service due to force majeure events. Users acknowledge that such events are beyond the reasonable control of Atom and agree to hold Atom harmless for any consequences arising from service interruptions caused by force majeure events. This includes, but is not limited to, financial losses, disruption to user experience, or loss of data that may occur during such events.

Suspension of Obligations
During the occurrence of a force majeure event, Atom’s obligations under these Terms shall be temporarily suspended. Atom will not be in breach of these Terms due to delays or failure to perform caused by a force majeure event. The suspension of services will continue for the duration of the event, and Atom will make reasonable efforts to resume service as soon as the force majeure condition subsides.

Efforts to Mitigate
Atom will make reasonable efforts to mitigate the effects of a force majeure event, including taking all necessary actions to restore services and minimize disruptions. While Atom strives to keep users informed and updated, it cannot guarantee the prevention of or compensation for any service interruptions caused by such events. The developers will act in good faith to resume normal service operations at the earliest possible time.

Notification of Force Majeure Events
In the event of a force majeure occurrence, Atom will notify users, whenever feasible, of any anticipated service disruptions. This notification may include information on the nature of the event, the estimated duration of the disruption, and any actions being taken by Atom to resolve the issue. However, users acknowledge that certain force majeure events (such as natural disasters) may occur without prior warning and may impact Atom’s ability to provide timely updates.

No Refunds or Compensation for Force Majeure Events
Users understand and agree that Atom is not liable for any loss or inconvenience caused by force majeure events. As such, users will not be entitled to refunds, credits, or other compensation for any period of service interruption, downtime, or failure to perform caused by a force majeure event. Atom’s obligation to provide services is suspended for the duration of the event, and once the event subsides, the services will be resumed as soon as feasible.

Force Majeure Does Not Excuse Non-Performance Indefinitely
Atom’s liability is only suspended for the duration of the force majeure event. If the event continues for an extended period (typically longer than 30 days), Atom may, at its discretion, consider alternative solutions, including providing users with access to partial services, or communicating with users regarding next steps. However, after a prolonged period of force majeure, Atom reserves the right to terminate services with adequate notice to users.

Indemnification for Force Majeure Impact
Users agree to indemnify, defend, and hold harmless Atom, its affiliates, employees, and agents from any claims, losses, damages, or liabilities arising from or related to delays, failures, or interruptions in service caused by force majeure events. This indemnification includes any third-party claims or lawsuits that may arise as a result of the event.

Continuing Obligation Post-Force Majeure
Once the force majeure event has ended and normal services are resumed, Atom’s obligations under these Terms will continue in full force. However, users acknowledge that the occurrence of a force majeure event may have temporary impacts on the availability or reliability of Atom’s services, and these impacts will not constitute a breach of contract or failure to perform under these Terms.

Atom reserves the right to modify, update, or enhance its features, functionalities, design, and overall layout at any time, with or without prior notice. These changes may include, but are not limited to, updates to the platform’s user interface, additions or removals of features, improvements in performance, changes in accessibility options, bug fixes, or any other adjustments that Atom deems necessary to improve the service or comply with industry standards.

Scope of Modifications
Modifications may affect one or more components of Atom, including but not limited to:

  • User Interface (UI): Changes to the design, layout, or navigation of Atom.
  • Features and Functionalities: Additions, removals, or changes to existing features, including but not limited to experience points, leaderboards, and other leveling functionalities.
  • Performance Enhancements: Improvements aimed at optimizing Atom’s speed, reliability, or compatibility with various platforms or devices.
  • Security Measures: Updates designed to enhance the security and privacy of user data and transactions.
  • Bug Fixes and Patches: Modifications to address issues or errors within the system, ensuring a smoother and more stable experience for users.

Notification of Modifications
Atom will notify users of significant changes or updates to the platform. Notifications may be provided through one or more of the following methods:

  • Release Notes: Atom may provide detailed release notes that explain the specific changes or improvements.

User Responsibility to Stay Informed
While Atom will make reasonable efforts to notify users of significant updates, it is the responsibility of users to stay informed about any changes to the platform. Users are encouraged to periodically check Atom’s official channels, such as the website, blog, or any in-app notification settings, for the latest updates or announcements. Continued use of Atom after an update signifies acceptance of the changes.

Impact of Modifications
Users acknowledge that modifications to Atom’s features or layout may impact their experience. Atom may update its services in a way that changes the functionality of certain features, introduces new ones, or removes outdated ones. In such cases, users may need to adapt to these changes in order to continue utilizing the service effectively. Atom is not responsible for any disruption or inconvenience caused by such modifications, but will strive to ensure that the platform remains user-friendly and responsive.

Reversions and Rollbacks
In the event that a modification or update introduces unforeseen issues or negative impacts on the user experience, Atom may roll back or revert specific changes. Atom will assess the situation and determine if a rollback is necessary to restore service functionality to its previous state. Users will be notified promptly if such an action occurs, along with details about the reversion and expected timeframes for any required fixes.

Beta Features and Testing
Atom may occasionally introduce beta features or experimental functionalities for testing purposes. Ownership of Submitted Feedback
When users submit feedback, suggestions, or other content (e.g., ideas for new features, improvements to existing functionalities, or reports of issues), they grant Atom a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, distribute, display, and otherwise exploit such content for any purpose, without any further compensation or acknowledgment. This includes the right to incorporate such feedback into Atom’s services, marketing materials, updates, or any other part of its operations.

No Confidentiality or Privacy Rights
Users acknowledge that any feedback or suggestions submitted to Atom will not be considered confidential. By submitting feedback, users waive any rights to claim that their ideas or feedback are proprietary or confidential. Atom is under no obligation to protect or safeguard the confidentiality of such submissions. Additionally, Atom is not required to provide any feedback on, or responses to, the suggestions submitted by users.

No Obligation to Act on Feedback
Atom is under no obligation to act on, implement, or respond to any feedback or suggestions submitted by users. While Atom values user input and may review and consider it for future updates, features, or improvements, Atom retains full discretion over which feedback to adopt, if any. Users understand that Atom is not required to take any specific actions based on their feedback and may choose to disregard, modify, or ignore any suggestions provided.

Impact of Feedback on Future Features
While Atom encourages users to share their thoughts and ideas, the submission of feedback does not guarantee that Atom will implement or adopt any of the suggestions. Atom’s development team will review all feedback and consider it as part of their ongoing efforts to improve the platform. However, Atom retains sole discretion in deciding which features, ideas, or improvements will be prioritized or implemented. Users understand that Atom is under no obligation to adopt their suggestions or inform them of any decisions related to the feedback provided.

Disclaimers Regarding Submitted Content
Atom does not make any representations or warranties regarding the use, adoption, or implementation of feedback, suggestions, or ideas provided by users. Atom also disclaims any liability for any damages or losses resulting from the submission of feedback, including but not limited to misunderstandings, frustration, or any negative outcomes arising from the process.

Encouraging Constructive Feedback
While Atom welcomes all types of feedback, users are encouraged to submit feedback in a constructive and respectful manner. Feedback that is offensive, abusive, or violates the platform’s standards of conduct may not be considered or may be subject to removal. Atom reserves the right to moderate and reject feedback that is deemed inappropriate.

Voluntary Participation
Participation in providing feedback is completely voluntary. Users may choose to submit suggestions or refrain from doing so without any negative consequences. Atom respects the privacy and autonomy of its users, and submitting feedback does not impact the user’s access to the platform or their rights as a member.

Lifetime Subscriptions

Lifetime subscriptions grant users access to premium features for as long as the Atom bot is operational. This means that, for the duration of Atom’s service, you will enjoy uninterrupted access to all features covered by your lifetime subscription. In the event that Atom is discontinued or shut down, we are committed to providing users with a fair and transparent transition.

Notification of Service Termination: If Atom is ever discontinued, we will give users a minimum of 3 months’ notice before the shutdown date. This advance notice will be communicated clearly and through all available channels, ensuring that users have enough time to adjust their plans. This notice period will allow users to make the necessary changes, such as transferring subscriptions (where applicable), backing up data, or making alternative arrangements to continue their experience.

We understand the importance of your subscription, and we aim to ensure that the process of discontinuation, should it ever occur, is handled in a manner that minimizes disruption to your community’s experience with Atom. During this 3-month period, you will continue to have access to all premium features as per the terms of your subscription.

Atom remains committed to providing a high-quality service, and we will keep you informed of any changes that may affect your subscription. Should you have any questions or concerns during this time, our support team will be readily available to assist.

Personalization

Personalization Model Allocation

  • The Personalization module is exclusively available for use on a single server per purchase.
  • Users are prohibited from applying the same personalized Atom instance across multiple servers.

Acceptable Use

  • The Personalization module may not be used for purposes of impersonation, fraud, or any form of misleading representation.
  • Users must adhere to Discord’s Terms of Service and Community Guidelines while configuring their bot’s identity.
  • The use of offensive, hateful, or inappropriate names, avatars, banners, or statuses is strictly prohibited.

Account & Server Ownership

  • Only users with administrator permissions are authorized to modify Personalization settings.
  • Continued access to the Personalization module is contingent upon the maintenance of an active Superatom subscription.
  • If server ownership is transferred, Personalization settings will remain active unless deactivated by the new server owner.

Abuse & Misuse

  • Any attempt to circumvent pricing tiers, exploit service loopholes, or gain unauthorized access to the Personalization module will result in the immediate suspension of access to the feature.
  • Users are prohibited from reselling, sharing, or distributing access to the Personalization module outside of their server.
  • Monetization or profit generation from the Personalized Atom instance, including but not limited to selling access, licensing, or offering it as a service, is strictly prohibited.
  • Repeated violations may result in the permanent revocation of access to the Personalization module, without entitlement to a refund.

Refunds & Cancellations

  • Should the Superatom subscription be cancelled, all Personalization features will be immediately disabled without any prorated refund.
  • Upon removal of Superatom from a server, access to all active Personalization settings will be revoked.

Modifications & Enforcement

  • Atom reserves the right to modify or update these terms as necessary to preserve the integrity of the service and to ensure equitable use by all parties.
  • Any violation of these terms may result in suspension or removal of service access, or other corrective actions as deemed necessary.
  • Users may submit appeals for enforcement actions via support.

Subscriptions and Purchases

All purchases and subscriptions are to be considered as voluntary, one-time donations towards the ongoing development, enhancement, and maintenance of the bot and its associated services. In exchange for these donations, users will be granted the corresponding subscription levels and associated features as outlined at the time of donation.

It is important to note that subscriptions are not subject to automatic renewal. Users are required to submit a new donation each time they wish to extend their subscription or regain access to subscription-based features. The absence of automatic renewal ensures that users retain full control over the continuation of their subscription and are under no obligation to maintain a subscription if they do not wish to do so.

By proceeding with a donation, users explicitly acknowledge and accept that subscriptions are not a recurring service, and that continued access to subscription-based features is contingent upon the submission of subsequent donations. All donations are non-refundable, and users understand that access to the bot’s subscription features may be revoked if a new donation is not made within the required timeframe.

Right to Assign

Atom reserves the absolute right, at its sole discretion, to transfer, assign, or delegate any of its rights, obligations, or responsibilities under these Terms to any third party, entity, or affiliate, without the need for user consent or prior notice. This includes, but is not limited to, the transfer of ownership, management, operation, or control of Atom’s services, assets, intellectual property, or any part of its business. Such transfer may occur in the event of a merger, acquisition, reorganization, sale of assets, or any other strategic business decision that Atom may pursue. Users acknowledge and agree that their continued use of Atom after such an assignment or transfer constitutes acceptance of the new terms, conditions, and policies imposed by the assignee or transferee, if any.

User Restrictions on Assignment
Users understand and agree that they have no right or ability to assign, transfer, sublicense, or otherwise delegate any of their rights, privileges, or obligations under these Terms to any third party, individual, or entity, without the express written consent of Atom. Any attempt by a user to assign, transfer, or delegate any of their rights, obligations, or access to Atom, including but not limited to their account, subscription, or any associated benefits, without the prior approval of Atom will be considered void and without legal effect. Users are prohibited from attempting to sublicense, sell, or otherwise transfer their account or access to any part of Atom’s services, either for commercial or personal use.

Assignment of Services and Obligations
In the event of a corporate reorganization, merger, acquisition, restructuring, or sale of all or part of Atom’s assets, services, or technology, Atom retains the unrestricted right to assign its rights, duties, and obligations under these Terms to the acquiring or successor entity. In such cases, users understand that their rights and obligations may transfer to the new owner or operator of the services, who may continue or alter the operation of Atom’s services. However, any such transfer will be subject to the continued adherence to these Terms and the Privacy Policy unless revised by the assignee.

Notification of Assignment
While Atom is not obligated to notify users prior to an assignment, Atom will make reasonable efforts to inform users in the event that an assignment occurs, especially if it affects the users’ access to or use of the services. This notification may be provided through announcements on the Atom Discord Support Server or any other appropriate means of communication. It is the user’s responsibility to monitor these communications for updates related to such assignments. Atom disclaims any liability for the failure to notify users of any assignment or transfer.

Impact of Assignment on User Accounts
In the event of an assignment, the new entity or party taking over Atom’s services may impose new terms, conditions, or policies on users. Users’ continued use of Atom’s services after such an assignment constitutes an agreement to comply with the new terms and conditions provided by the assignee. Atom will make reasonable efforts to provide users with clear notice of any such changes, but users are responsible for reviewing and understanding the updated terms and conditions. If users disagree with the new terms following an assignment, their sole remedy will be to discontinue use of Atom’s services.

Effect of Transfer on Payment and Subscription Terms
Should an assignment occur, the assignee may have the right to assume responsibility for managing user subscriptions, payment terms, and billing information. This could involve the transfer of existing subscriptions to the new entity or the continuation of the subscription under the new terms. Users acknowledge and agree that their subscription services may be impacted by the assignment, and Atom or the assignee will provide appropriate communication regarding any necessary actions or changes required from the user, including updates to billing information or subscription renewal terms.

No Responsibility for User Transfer of Rights
Users are reminded that any attempt to assign, transfer, or sublicense any rights or obligations under these Terms without Atom’s prior written consent is prohibited and will be deemed void. Atom will not recognize any assignment, transfer, or sublicensing of rights by users to third parties and reserves the right to take action, including termination of user access to Atom, if such an unauthorized assignment is discovered.

Right to Enforce Terms Post-Assignment
Following an assignment, Atom (or the assignee) retains the right to enforce these Terms, along with any other policies or guidelines associated with Atom’s services, against users. Users are bound by all applicable terms, including those in relation to the use of Atom’s services and content, even after the assignment of rights. The assignee shall have the same legal rights to enforce the Terms and the Privacy Policy as Atom, including the right to suspend, terminate, or modify user access to the services as deemed necessary.

Indemnity Following Assignment
Users agree to indemnify, defend, and hold harmless Atom, its affiliates, subsidiaries, and successors from any claims, damages, or losses arising from any attempt by users to assign or transfer their rights or obligations under these Terms without Atom’s prior written consent. Users acknowledge that such unauthorized actions could result in legal, financial, or operational consequences that Atom, its affiliates, or successors may seek to recover.

Assignment and User Rights Under Law
Nothing in these Terms shall limit or affect any legal rights users may have under applicable law regarding their right to assign or transfer any contractual rights or obligations. However, except as required by law, no user may transfer any rights to third parties under these Terms without Atom’s express prior written consent. Atom’s right to assign or transfer its rights and obligations is not subject to such restrictions, and its actions in doing so will not impact users’ statutory rights.

No Partnership or Agency

By using Atom’s services, users acknowledge and agree that no partnership, joint venture, agency, or similar relationship is created between Atom and the users, except as expressly stated in a formal written agreement or designation. Atom and users are independent entities, and nothing in these Terms shall be construed as creating any relationship of joint venture, partnership, or agency between Atom and its users, or any other third parties. Each party acts independently and retains sole responsibility for its actions and obligations.

Except for Formal Partnerships
In specific instances where a formal partnership, joint venture, or agency relationship is established, it will be explicitly stated in a written agreement, such as an official memorandum of understanding, partnership agreement, or terms of service document signed or approved by representatives of both Atom and the partnering organization. In these cases, the rights, responsibilities, and obligations of the parties will be governed by the specific terms outlined in such an agreement. Only in these clearly defined and agreed-upon situations shall any representation or designation be made of Atom and another entity as partners or joint venturers.

No Implied Agency
Except as specifically stated in any valid written partnership agreement, nothing in these Terms shall be construed as granting any party the authority to act as the agent, representative, or legal representative of Atom, nor does Atom grant such authority to any user, partner, or third party. Users may not bind Atom to any obligations, contracts, or agreements without Atom’s explicit and prior consent. Similarly, Atom cannot and does not bind users or third parties to any commitments or agreements beyond the scope of these Terms and applicable service agreements.

Independence of the Parties
Both Atom and its users operate independently from each other, and each party is solely responsible for its actions and obligations under these Terms. No collaboration or communication between Atom and users should be construed as the formation of a partnership or agency relationship. Atom does not guarantee, endorse, or support any products, services, or activities promoted by users or third parties, and users should not assume that such endorsements exist unless explicitly stated in writing by Atom or in formal partnership agreements.

Implications for Users
Users must understand that they cannot represent themselves as agents, representatives, or affiliates of Atom, nor can they claim any association that might suggest such a relationship unless explicitly authorized by Atom. Any attempt to do so may result in disciplinary action, including termination of access to Atom’s services. Similarly, users must not create or present any false representation that Atom is responsible for or associated with their activities, business dealings, or undertakings unless there is a formal agreement to that effect.

No Joint Liability
In the absence or presence of an explicitly defined partnership, joint venture, or agency agreement, neither Atom nor users will be liable for the actions or obligations of the other. The use of Atom’s services does not create any shared financial liability or responsibility for debts, damages, losses, or claims arising out of users’ activities or actions outside the scope of using Atom’s services as defined by these Terms.

Exclusion of Specific Representation or Endorsement
The use of Atom’s services does not imply that Atom endorses, is involved with, or has control over any actions taken by users, except as specifically outlined in an agreement. Any statements made by users about Atom’s involvement in their activities, business, or services must be considered false or misleading unless backed by a formal partnership or joint venture agreement.

Notification of Official Partnerships
In the event that Atom enters into a formal partnership with another entity, users will be informed through official channels, such as updates to the Terms of Service or announcements on Atom’s platform. These communications will clearly outline the terms and conditions of the partnership, including any special terms or privileges that may apply to users involved in the partnership. Any partnership terms will be separately negotiated and agreed upon by the parties involved and will not affect the general user terms unless specified.

Atom reserves the right, at its sole discretion, to modify, update, or amend these Terms of Service at any time, with or without prior notice. This includes changes to any terms, conditions, rules, policies, or guidelines that govern the use of Atom. Such modifications may be necessary to reflect changes in the operation of Atom, legal requirements, or evolving industry standards. Users will be notified of any material changes to these Terms via the Atom website, through notifications within the Atom service itself, or via direct communication to the registered contact provided by the user. These notifications may appear in the form of a banner, pop-up notification, or email, depending on the nature of the update and the user’s preferences.

Notification of Changes:
Atom will make reasonable efforts to notify users of any significant changes to these Terms. However, it is the user’s responsibility to periodically check for any updates or revisions, as changes may occur without immediate notification. Users acknowledge that such modifications may be posted on the Atom website or within the service itself, and that their continued use of Atom after the changes have been made constitutes their acceptance of the updated Terms. If users do not accept the modified Terms, they must immediately cease using Atom.

Effective Date of Changes:
Any changes made to these Terms will be effective immediately upon publication unless otherwise stated. Users are encouraged to review these Terms regularly to remain informed about any updates. In some cases, Atom may provide a grace period during which users can familiarize themselves with the changes before they become effective, but this is not guaranteed. The date of the last update to these Terms will always be clearly stated at the top of the document.

User Responsibility to Review Terms:
It is the responsibility of each user to regularly review the Terms of Service, as it is possible for terms to be modified without explicit notice to individual users. By continuing to use Atom, users agree to be bound by any updated or amended Terms. If users do not agree with the revised Terms, they must stop using Atom immediately. Failure to do so will be deemed as acceptance of the changes.

Discontinuation of Use:
If a user disagrees with any part of the revised Terms, their only remedy is to stop using Atom. Atom developers are not responsible for any losses, damages, or inconveniences users may experience as a result of changes to the Terms. Atom may also discontinue offering certain features, services, or components of Atom at its discretion, and users acknowledge that they will not hold Atom developers responsible for any disruption of service, loss of access, or any other consequence that may result from such changes.

Unilateral Right to Modify:
Atom developers retain the unilateral right to modify, remove, or add terms to these Terms of Service at any time, with or without notice, and are not obligated to continue providing prior versions of the Terms. While users are encouraged to regularly check for updates, Atom is not responsible for notifying users individually regarding each change. All modifications to these Terms are made at the discretion of Atom developers and are subject to applicable law.

Acceptance of Changes:
By continuing to use Atom after any modifications to these Terms, users explicitly agree to the revised Terms. If users disagree with any revisions, they must cease using Atom immediately. Continued use after the effective date of any changes will be considered as acceptance of the new terms, regardless of whether the user has explicitly reviewed the updated Terms. Users acknowledge and agree that the Terms and conditions provided here supersede any prior version or agreement, and that any modifications or updates will be incorporated into this agreement.

Special Circumstances:
In some cases, Atom may need to implement changes that are urgent, such as updates to comply with legal obligations or to prevent harm to the service or its users. In such cases, Atom may implement changes without prior notification, although users will still be notified as soon as reasonably possible. Users are expected to understand and accept these changes as part of their use of Atom, and they agree that Atom developers will not be held liable for any loss or inconvenience caused by such immediate changes.

Legality and Enforceability:
If any part of these revised Terms is found to be unenforceable or invalid under applicable law, the remainder of the Terms will remain in full effect. Any modification made to these Terms shall be deemed to be incorporated into the Terms from the date of its publication or the effective date specified. If any court or competent authority rules that any part of these Terms is invalid or unenforceable, the remaining provisions will continue to be enforceable and in effect.

Rescission or Revision of Previous Terms:

Termination

Atom reserves the right, at its sole discretion, to suspend, restrict, or permanently terminate a user’s access to Atom, either in whole or in part, at any time and for any reason, with or without cause, and without prior notice. This includes, but is not limited to, situations where Atom developers believe a user has violated these Terms of Service, engaged in unauthorized activities, or abused the Atom service in any way. Termination of access will result in the immediate revocation of the user’s right to use Atom and any related services, features, or functionalities. Upon termination, the user is prohibited from accessing, using, or attempting to use Atom in any manner, and any ongoing use or attempt to use the platform after termination will be considered a violation of these Terms.
